Algemene verkoopsvoorwaarden voor tickets

Artikel 1 – Algemeen

Deze algemene verkoopsvoorwaarden zijn van toepassing op de aankoop en het gebruik van tickets voor alle evenementen georganiseerd door:

hierna beschreven als organisator of elke afgeleide vorm hiervan.

Door een ticket te bestellen, te betalen of te gebruiken, verklaart de koper kennis te hebben genomen van deze algemene verkoopsvoorwaarden en deze te aanvaarden.

De organisator behoudt zich het recht voor deze voorwaarden te wijzigen wanneer dit noodzakelijk is. De voorwaarden die van toepassing zijn op het moment van aankoop blijven van toepassing op de betreffende bestelling, behoudens wijzigingen die voortvloeien uit wettelijke verplichtingen of noodzakelijke organisatorische maatregelen.

Artikel 2 – Officiële ticketverkoop

Tickets voor de evenementen van de organisator worden uitsluitend officieel verkocht via de website: https://momentsofenchantment.be

De organisator garandeert de geldigheid en authenticiteit van tickets die via het officiële verkoopkanaal werden aangekocht en waarvan de betaling correct werd ontvangen.

Tickets die worden aangeboden of verkocht via andere websites, sociale media, zoekertjessites, online marktplaatsen, particuliere personen of andere niet-officiële kanalen, worden niet door de organisator verkocht en vallen buiten de verantwoordelijkheid van de organisator.

De organisator kan de geldigheid van dergelijke tickets niet garanderen.

Artikel 3 – Geldigheid van het ticket

Elk ticket geeft, behoudens andersluidende vermelding, uitsluitend toegang tot het evenement, de datum en eventueel het tijdstip waarvoor het ticket werd uitgegeven.

Een ticket is slechts geldig indien het door het officiële ticketsysteem van de organisator als geldig wordt erkend.

Elk ticket bevat een unieke identificatie, zoals een barcode, QR-code, ticketnummer of andere controlegegevens. Deze gegevens kunnen bij de ingang worden gecontroleerd.

Wanneer dezelfde ticketcode meermaals wordt aangeboden, kan slechts de eerste geldige registratie toegang geven tot het evenement. De organisator is niet verantwoordelijk voor schade of verlies dat voortvloeit uit het delen, kopiëren, doorsturen of doorverkopen van een ticket.

Het is daarom belangrijk dat de koper zijn ticket en de bijbehorende toegangsgegevens zorgvuldig bewaart.

Artikel 4 – Toegang tot het evenement

De organisator behoudt zich het recht voor om de toegang te weigeren wanneer:

  • het ticket ongeldig blijkt te zijn;
  • het ticket reeds eerder werd gebruikt;
  • het ticket vervalst of gewijzigd blijkt te zijn;
  • de gegevens op het ticket niet overeenstemmen met de gegevens in het ticketsysteem;
  • het ticket op onrechtmatige wijze werd verkregen;
  • het ticket op een andere wijze niet aan de toegangsvoorwaarden voldoet;
  • of wanneer de bezoeker de geldende huis- of veiligheidsregels niet naleeft.

Een ticket geeft geen absoluut recht op toegang indien het ticket niet geldig blijkt te zijn of indien de bezoeker niet voldoet aan de toepasselijke toegangsvoorwaarden.

Artikel 5 – Verantwoordelijkheid van de koper

De koper is verantwoordelijk voor het correct bewaren van het ticket en voor het voorkomen dat derden toegang krijgen tot de ticketgegevens.

De koper dient bij aankoop steeds na te gaan of de bestelling, de datum, het evenement, het aantal tickets en de overige gegevens correct zijn.

De organisator is niet verantwoordelijk voor fouten die het gevolg zijn van het verstrekken van verkeerde gegevens door de koper.

Artikel 6 – Prijs en betaling

De prijs van het ticket is de prijs die op het moment van aankoop duidelijk wordt vermeld via het officiële verkoopkanaal.

De aankoop wordt pas definitief nadat de betaling succesvol is ontvangen en de koper een bevestiging van de bestelling heeft ontvangen, tenzij anders vermeld.

Eventuele bijkomende kosten worden voorafgaand aan de betaling duidelijk aan de koper meegedeeld.

Artikel 7 – Geen herroepingsrecht / terugbetaling

De Koper beschikt niet over een herroepingsrecht zoals bepaald in artikel VI.47 Wetboek Economisch Recht. De verkoop van tickets gebeurt steeds op naam en is aldus uitgesloten van herroepingsrecht. Verkoop B2B is in elk geval uitgesloten van toepassing van het herroepingsrecht. Als Consument beschik je in dit geval ook niet over het recht om van de aankoop af te zien. Het herroepingsrecht is dus niet van toepassing aangezien het om een dienst, c.q. de reservering van tickets gaat die onmiddellijk wordt uitgevoerd. Door akkoord te gaan met deze algemene voorwaarden verklaar je als Consument uitdrukkelijk dat je geen recht meer hebt op het herroepingsrecht zodra de organisator de overeenkomst heeft uitgevoerd. Dit is het geval van zodra je de bevestiging hebt ontvangen. De Koper heeft geen recht op herroepingsrecht omwille van de volgende uitzonderingen op het herroepingsrecht:

  • Dienstenovereenkomsten na volledige uitvoering van de dienst als de uitvoering is begonnen met uitdrukkelijke voorafgaande instemming van de consument, en mits de consument heeft erkend dat hij zijn herroepingsrecht verliest zodra de onderneming de overeenkomst volledig heeft uitgevoerd; (Artikel VI.53.1° Wetboek Economisch Recht)
  • De levering van volgens specificaties van de consument vervaardigde goederen, of die duidelijk voor een specifieke persoon bestemd zijn; (Artikel VI.53.3° Wetboek Economisch Recht)

Artikel 8 – Annulering, wijziging of verplaatsing van het evenement

De organisator behoudt zich het recht voor om, indien noodzakelijk, het programma, de locatie, de openingsuren of andere praktische aspecten van het evenement te wijzigen.

Bij annulering of verplaatsing van het evenement zal de organisator de bezoekers, voor zover redelijkerwijs mogelijk, informeren via de officiële communicatiekanalen.

Indien bij annulering of verplaatsing een recht op terugbetaling bestaat, wordt dit meegedeeld door de organisator, samen met de toepasselijke modaliteiten en termijnen.

De organisator is niet verantwoordelijk voor kosten die bezoekers buiten de ticketprijs hebben gemaakt, zoals reis-, hotel-, parkeer- of andere persoonlijke kosten, voor zover de wet niet anders bepaalt.

Artikel 9 – Verlies, diefstal of beschadiging

Bij verlies, diefstal, beschadiging of onleesbaarheid van een ticket kan de organisator de toegang weigeren wanneer het ticket niet langer geldig of controleerbaar is.

De organisator is niet verplicht om verloren, gestolen of beschadigde tickets te vervangen of terug te betalen, behoudens wanneer de wet anders bepaalt.

Artikel 10 – Verbod op misbruik van tickets

Het is verboden tickets te vervalsen, te kopiëren, te manipuleren of op enige andere frauduleuze wijze te gebruiken.

Het is eveneens verboden ticketgegevens te gebruiken voor frauduleuze of commerciële doeleinden zonder voorafgaande toestemming van de organisator.

Bij vaststelling van fraude of misbruik kan het betreffende ticket ongeldig worden verklaard en kan toegang tot het evenement worden geweigerd.

De organisator behoudt zich het recht voor om bij vermoedens van fraude passende maatregelen te nemen en, indien noodzakelijk, aangifte te doen bij de bevoegde instanties.

Artikel 11 – Officiële communicatie

Alle officiële informatie over tickets, evenementen, wijzigingen, eventuele doorverkoopmogelijkheden en toegangsvoorwaarden wordt uitsluitend verspreid via de officiële communicatiekanalen van Moments of Enchantment.

Bezoekers worden aangeraden om bij twijfel steeds de officiële website te raadplegen en niet af te gaan op informatie van derden.

Artikel 12 – Aansprakelijkheid

De organisator kan niet aansprakelijk worden gesteld voor schade die voortvloeit uit de aankoop van een ticket via een niet-officieel verkoopkanaal.

Dit omvat onder meer schade die ontstaat doordat:

  • een ticket vervalst blijkt te zijn;
  • een ticket reeds door iemand anders werd gebruikt;
  • een ticket ongeldig werd verklaard;
  • een ticket niet werd geleverd door een derde partij;
  • de verkoper van een tweedehands ticket niet bereikbaar blijkt;
  • of de toegang tot het evenement wordt geweigerd wegens de ongeldigheid van het ticket.

Deze bepaling geldt binnen de grenzen van de toepasselijke wettelijke bepalingen en doet geen afbreuk aan aansprakelijkheid die wettelijk niet kan worden uitgesloten.

Artikel 13 – Persoonsgegevens

Persoonsgegevens die tijdens de ticketverkoop worden verzameld, worden verwerkt overeenkomstig de toepasselijke privacywetgeving en het privacybeleid van de koper.

Artikel 14 – Toepasselijk recht

Op deze algemene verkoopsvoorwaarden en de overeenkomsten tussen de organisator en de koper is het Belgisch recht van toepassing, tenzij dwingende wettelijke bepalingen anders bepalen.

Eventuele geschillen worden behandeld door de bevoegde rechtbanken overeenkomstig de toepasselijke wettelijke bepalingen.

General terms and conditions of sale for tickets

Article 1 – General

These general terms and conditions of sale apply to the purchase and use of tickets for all events organized by:

hereinafter referred to as the organiser or any derivative form thereof.

By ordering, paying or using a Ticket, the Purchaser declares to have read and accepted these General Terms and Conditions of Sale.

The organiser reserves the right to change these terms and conditions when necessary. The terms and conditions applicable at the time of purchase remain applicable to the order in question, subject to changes resulting from legal obligations or necessary organizational measures.

Article 2 – Official ticket sales

Tickets for the organiser's events are only officially sold via the website: https://momentsofenchantment.be

The organiser guarantees the validity and authenticity of tickets purchased through the official sales channel and for which payment has been received correctly.

Tickets offered or sold through other websites, social media, classified sites, online marketplaces, private individuals or other unofficial channels are not sold by the organiser and are not the responsibility of the organiser.

The organiser cannot guarantee the validity of such tickets.

Article 3 – Validity of the ticket

Unless otherwise stated, each ticket only gives access to the event, the date and, if applicable, the time for which the ticket was issued.

A ticket is only valid if it is recognized as valid by the official ticket system of the organiser.

Each ticket contains a unique identifier, such as a barcode, QR code, ticket number or other control data. This data can be checked at the entrance.

If the same ticket code is presented several times, only the first valid registration can give access to the event. The organiser is not responsible for any damage or loss resulting from the sharing, copying, forwarding or resale of a ticket.

It is therefore important that the buyer keeps his ticket and the associated access data carefully.

Article 4 – Access to the event

The organiser reserves the right to refuse entry when:

  • the ticket is found to be invalid;
  • the ticket has already been used;
  • the ticket is found to be forged or altered;
  • the data on the ticket does not match the data in the ticket system;
  • the ticket was obtained unlawfully;
  • the ticket does not meet the conditions of entry in any other way;
  • or when the visitor does not comply with the applicable house or safety rules.

A ticket does not give an absolute right of access if the ticket is found to be invalid or if the visitor does not meet the applicable entry conditions.

Article 5 – Responsibility of the buyer

The buyer is responsible for keeping the ticket correctly and for preventing third parties from accessing the ticket details.

The buyer must always check whether the order, the date, the event, the number of tickets and the other information are correct.

The organiser is not responsible for errors resulting from the provision of incorrect information by the buyer.

Article 6 – Price and payment

The price of the ticket is the price that is clearly stated through the official sales channel at the time of purchase.

The purchase will only become final after the payment has been successfully received and the buyer has received confirmation of the order, unless otherwise stated.

Any additional costs will be clearly communicated to the buyer prior to payment.

Article 7 – No right of withdrawal / refund

The Buyer does not have a right of withdrawal as stipulated in Article VI.47 of the Code of Economic Law. The sale of tickets is always done by name and is therefore excluded from the right of withdrawal. B2B sales are in any case excluded from the application of the right of withdrawal. As a Consumer, you do not have the right to cancel the purchase in this case. The right of withdrawal does not apply as it concerns a service, or the reservation of tickets, which is carried out immediately. By agreeing to these general terms and conditions, you as a Consumer expressly declare that you are no longer entitled to the right of withdrawal as soon as the organiser has executed the agreement. This is the case as soon as you have received the confirmation. The Buyer is not entitled to the right of withdrawal due to the following exceptions to the right of withdrawal:

  • Service contracts after full performance of the service if the performance has begun with the consumer's express prior consent, and provided that the consumer has acknowledged that he loses his right of withdrawal once the company has fully performed the contract; (Article VI.53.1° of the Code of Economic Law)
  • The supply of goods manufactured to the consumer's specifications, or which are clearly intended for a specific person; (Article VI.53.3° of the Code of Economic Law)

Article 8 – Cancellation, modification or rescheduling of the event

The organiser reserves the right, if necessary, to change the program, location, opening hours or other practical aspects of the event.

In the event of cancellation or rescheduling of the event, the organiser will inform visitors via the official communication channels as far as reasonably possible.

If there is a right to a refund in the event of cancellation or rescheduling, this will be communicated by the organiser, together with the applicable modalities and deadlines.

The organiser is not responsible for costs incurred by visitors outside the ticket price, such as travel, hotel, parking or other personal costs, unless otherwise provided by law.

Article 9 – Loss, theft or damage

In the event of loss, theft, damage or illegibility of a ticket, the organiser may refuse access if the ticket is no longer valid or verifiable.

The organiser is not obliged to replace or refund lost, stolen or damaged tickets, unless otherwise provided by law.

Article 10 – Prohibition of misuse of tickets

It is forbidden to forge, copy, manipulate or use tickets in any other fraudulent way.

It is also forbidden to use ticket data for fraudulent or commercial purposes without the prior permission of the organiser.

If fraud or abuse is detected, the ticket in question may be declared invalid and access to the event may be denied.

The organiser reserves the right to take appropriate measures in the event of suspicion of fraud and, if necessary, to report it to the competent authorities.

Article 11 – Official communication

All official information about tickets, events, changes, possible resale opportunities and access conditions will be distributed exclusively through the official communication channels of Moments of Enchantment.

Visitors are advised to always consult the official website when in doubt and not to rely on information from third parties.

Article 12 – Liability

The organiser cannot be held liable for damage resulting from the purchase of a ticket through an unofficial sales channel.

This includes damage caused by:

  • a ticket turns out to be forged;
  • a ticket has already been used by someone else;
  • a ticket was declared invalid;
  • a ticket was not provided by a third party;
  • the seller of a second-hand ticket cannot be reached;
  • or access to the event is refused due to the invalidity of the ticket.

This provision applies within the limits of the applicable legal provisions and does not affect liability that cannot be excluded by law.

Article 13 – Personal data

Personal data collected during ticket sales will be processed in accordance with applicable privacy laws and the buyer's privacy policy.

Article 14 – Applicable law

These general terms and conditions of sale and the agreements between the organiser and the buyer are governed by Belgian law, unless mandatory legal provisions provide otherwise.

Any disputes will be dealt with by the competent courts in accordance with the applicable legal provisions.
